Rental Terms and Conditions

 

Guest hereby certifies and agrees that s/he has received and read these Rental Terms and Conditions and further agrees to abide by all the rules and regulations contained herein and related to the rental of the Rental Property.  Guest obligations include but are not limited to keeping the premises as clean and safe as the conditions of the premises permit and causing no unsafe or unsanitary conditions in the common area and remainder of the premises that guest uses; and, will notify CBVR of the need of replacement of or repairs to a smoke detector, and replacement batteries during occupancy.  Guest must check smoke detectors upon arrival and notify CBVR immediately for any and all malfunctions to same. Guest agrees not to use the property for any wedding receptions/parties, or erect tents for outdoor entertainment or sleeping.  Guest breach of any duty contained in this document shall be considered material, and can result in the termination/eviction of guests’ occupancy with no refund of any kind.

Location of Cannon Beach Vacation Rental Office:  Keys are picked up and dropped off at the Cannon Beach Vacation Rental office located at 164 Sunset Blvd in midtown Cannon Beach.  Our location is in a cottage on the north side of the street with a picket fence in front.  No parking is allowed at the CB Fire Station property located directly east of our building or along Sunset Blvd, violators can be ticketed or towed.  Please turn in at the picket fence for short term parking on our property while checking in or out.

Check-in, Check-out times:  Check-in time is approximately 4:00 pm.  Check- out time is 11:00am.  Check-in time may be delayed occasionally during the high season.  Early check-in may be possible outside the high season and the possibility must be confirmed prior to arrival.

Office Hours:  Our office hours fluctuate during the year; please call our office for current hours.  Our office is closed Sand Castle Day, Easter, July 4th, Thanksgiving, Christmas and New Year’s Day.  If you are checking in on one of those days, arrangements will be made prior to your arrival for your check-in. 

Late Check-ins:  All late check-ins are set up in advance.  Guests must contact our office to make the necessary arrangements for after hours check-ins.

Pets:  Many of our homes permit dogs; none of our homes permit cats.  Pets must be confined to those homes that allow them.   Undeclared pets found in or about a no pet house are grounds for expedited eviction and forfeiture of any monies paid and a non-declared pet charge of $150 per week, or any portion thereof at CBVR’s sole option, the cost for cleaning carpets to restore a house to original condition will also be charged for any pets in non-pet friendly houses..  Our pet fee is $50 per pet, per stay and is non-refundable; any damage caused by a pet will be subject to additional charges.  Pets are not allowed to remain in rentals unattended unless confined to a crate.  Cannon Beach has a leash law; all pets not under direct voice command must be leashed when outside the rental and should not disturb neighbors.  All pet excretions must be picked up and properly disposed, even on the beach.  Our policy for “service animals” as defined in the Americans with Disabilities Act recognizes that vision, mobility, hearing and certain other disabilities may need greater accommodation than those with allergic disabilities. Service animals under the ADA are “guide dogs, signal dogs or other animals individually trained to do work or perform tasks for the benefit of an individual with a disability”.  If one of the intended occupants of a rental has a disability and is assisted by a service animal, please alert us in advance as to the specifics so that accommodation can be made while minimizing the potential harm to other guests disabled by serious allergic reactions to animals.  It is requested that such an animal remain at all times under the direct control of the occupant with the disability and that the service animal wear something identifying it as such at all times.  A normal pet fee and carpet cleaning to restore a property to its original non-pet condition will be charged for any animals, if accommodated in a house that does not normally allow pets.

Smoking:  None of our rentals permit smoking inside the rentals.  If smokers occupy one of our rentals they must either smoke outside or off the property depending on the requirements of the homeowner.  Under all circumstances cigarette butts must be policed and disposed of properly.  Failure to take proper care of your debris will result in additional charges for cleaning of interior and/or exterior of the property.

Linens and towels:  Linens and towels are provided; guest is responsible for lost or damaged items.  Please do not use our linens and towels for spills and clean ups, paper towels are provided for guest use in unit.  Blankets and towels are not to be taken away from property.  Please bring your own beach towels and beach blankets.

Number of Guests Permitted in Houses:  The number of people allowed to stay at a rental is first determined by the City of Cannon Beach and is occasionally curtailed further by the homeowner.  When information is gathered by our staff to guide you through the reservation process, we advise you of the total number of people permitted in a property; it is also noted on our website description of the property.  This rule applies to all persons staying at the property over the age of two.  There are no exceptions.  The City of Cannon Beach has occupancy ordinances designed to keep Cannon Beach a place you would like to visit again.  Our ordinance is designed to not overtax our city services and failure to comply is a violation of City of Cannon Beach ordinance and a violation of our rental agreement and is subject to fine and immediate eviction from the property.

Parking:  The number of cars permitted at rentals is primarily determined by the City of Cannon Beach.  Each house has a parking plan posted in the house and provided at check-in.  The number of cars is specified on our website and in our rental agreement.  There are no exceptions to the number of permitted vehicles.  Additional vehicles can be legally parked on city streets where allowed.  At no time will campers or RV’s be allowed to park on a rental property.  Other arrangements must be made for these types of vehicles either at a local RV park or with direct communication with the City of Cannon Beach Police Department.

Payment for Rental:  All rentals must be paid in full 30 days prior to occupancy.  A deposit, as specified in Rental Agreement is required within 7 days of initial reservation. A fully signed contract and initialed Rental Terms and Conditions must be received by our office with the initial deposit or full payment.  Guest acknowledges that a non refundable reservation fee of $80.00 will be payable to CBVR for services involved with procuring this rental for guest.  This charge has been included in Rental Agreement and is payable with the initial payment.  Guest also acknowledges that travel protection insurance has been offered and if accepted, the non-refundable premium is due no later than 30 days prior to occupancy.  To protect against the loss of your rental payments, travel insurance is strongly recommended. Guest is not entitled to any claim against CBVR or Owner arising out of guests’ inability to complete his/her vacation plans for any reason outside the control of CBVR or Owner. 

Damage Waiver:  A charge has been included with your reservation fees to cover unintentional damage up to $1500. All unintentional damages must be reported to the CBVR office so a damage report can be filed. The Damage Waiver does not limit the responsibility of contract holder for additional charges if necessary. Guest agrees to be responsible for any and all intentional damage, including breakage, theft, unnecessary maintenance, garbage in excess of 2 cans per week, excessive cleaning beyond what would be ordinary upon departure. Guest authorizes CBVR to charge the costs of any intentional damage to the credit card on record.  Guest Initials _____ In the event of a litigation to recover damages, CBVR administrative time will be a part of the cost of damage and CBVR will be entitled to recover any attorney fees, costs and disbursements incurred prior to litigation, during litigation, and any subsequent appeal thereof. Any litigation regarding this vacation rental or Cannon Beach Vacation Rentals must be filed in Clatsop County, State of Oregon.

Responsible persons:  Reservation and rental agreement can only be completed by someone at least 25 years old unless with prior written approval by CBVR.  The person that secures the rental, by signing the Rental Agreement will be considered the Responsible person in all aspects of this Agreement.  Subletting of rental home or any portion thereof is prohibited; person entering into rental agreement will be responsible for any damages occurring to property during the contracted rental period.  Person entering into Rental Agreement will be responsible also for actions of all guests to the property during their tenure, including but not limited to threatening or menacing behavior, inflicting personal injury on anyone, intentionally inflicts substantial damage to the premises or any part thereof, commits any act which is outrageous in extreme behavior, or would be considered a breach of the peace in this community.

Cancellation Policy:  Please contact our office as soon as possible in the event you must cancel or change properties.  We will only refund your advance/final rental payments (less travel insurance fees if applicable, reservation fee, and $75.00 cancellation fee) if the property is re-rented for the same time period.  Once your reservation has been confirmed, any cancellations date or property changes will be subject to this cancellation policy.  To prevent loss of rental payments we strongly recommend purchasing CSA Travel Protection.

Travel Protection Insurance:  Travel Insurance is administered through CSA Travel Protection. The plan is optional but we strongly recommend that you protect your investment with CSA320 Protection Plan; please review travel insurance brochure to be certain that your reasons for cancellation would be covered. CSA is an independent company and not an affiliate of CBVR.  IF YOU CHOOSE NOT TO PURCHASE THIS COVERAGE, SEE CBVR’S CANCELLATION POLICY – See Cancellation Policy above.  You can decline the coverage by signing the waiver on your Rental Agreement.  Questions concerning CSA Travel Protection can be obtained by reviewing the certificate of insurance on their website www.vacationrentalinsurance.com or calling 800-554-9839.

Termination by Owner/Substitutions: CBVR strives to comply with all reservation requests for specific vacation properties.  However, due to ownership changes, properties being removed from rental use, mechanical problems, or other unforeseen circumstance, CBVR cannot absolutely guarantee a specific rental property.  CBVR reserves the right to change assignments without notice or liability should the unit or property become unavailable.  When comparable accommodations are not available, Guest will have the option of selecting from available properties at the published rate or receiving a complete refund of their reservation deposit.

Guest Responsibilities at Departure:   Heat is to be set at 60 degrees; all interior lights are to be turned off.  Garbage is to be placed in outside receptacle; bungee cord firmly securing the container to protect the garbage from raccoons.  All recycling is to be placed in recycling container or in paper bags.  Failure to recycle will result in additional charges for garbage pickup.   Recycling can also be sorted and taken to the City of Cannon Beach Recycling Center located at the east end of Second Street in downtown Cannon Beach.  Rental should be straightened, furniture returned to original places, dishes either washed or loaded into dishwasher and dishwasher turned on.  Do not strip the beds – but please do not make them either, just leave them unmade.  We always appreciate a load of towels being started in the washer, but this is not required.  Close and lock all windows and lock all exterior doors.  Return key to Cannon Beach Vacation Rental office.  A key drop box is located outside our back door on the north side of our property for keys returned when office is closed.  Failure to return keys will result in a $25 charge per key, failure to return garage door opener where applicable will result in charge of $100.

Returned Items:  A $25 fee applies to any lost and found items that CBVR returns to guests; Items found and not claimed within 30 days will be disposed of at the discretion of CBVR.

System or equipment malfunction during stay:  Call our office to let us know about malfunctions or breakage immediately.  We cannot guarantee 100% function of all equipment in a rental, but will make arrangements for repairs within reason and as quickly as possible.

Communication Services:  Most of our rentals have cable or Satellite service available.  Most rentals have a VCR and/or DVD.  Many of our rentals have high speed internet service available, not all are set up for wireless, so accompanying cables may be needed by the guest.  Most units also have CD players.  Phone service, if provided, is limited to local and toll free service only.  If a guest uses the phone line for dial up internet access, additional fees will be charged based on usage noted on phone bills.  Any unusual phone charges that are unauthorized are responsibility of Guest

BBQ grills:  Many but not all units are equipped with BBQ grills.  You can call the office to determine whether one is available and what type it is.  Propane is provided for gas grills, charcoal is not provided for charcoal grills.

Medical Emergency:  In the event of a medical emergency, please call 911.  Cannon Beach Volunteer Rural Fire Protection District will respond to all emergency calls.  The nearest hospital is located in Seaside approximately 10 miles north of Cannon Beach.

Tsunami/Earthquake Warning:  If you hear a warning siren while on the beach - please get off the beach immediately and always head to high ground east of Hwy 101 as quickly as possible.  If you are in a home and are not certain whether you are on high ground, always choose to evacuate to the east side of Hwy 101 on high ground.  Please walk quickly; it is best if you do not try to drive since it may not be
